In such a situation, “typically” not only a statement from one side or the other is needed, but also some evidence base is needed to be able to achieve a “just settlement in this situation”, the lawyer said.
“However, the fact that there are no witnesses to the accident does not always mean that this type of violation cannot be properly recorded and the violator prosecuted. There are various ways to achieve this, including if there are any physical injuries, then it is necessary to record them in a medical institution. And then you have to contact the State Police for this same violation,” said Dzanuškāns in TV24’s “On the Line” program, in response to a viewer’s question.
In addition, the lawyer added: “The severity of the injuries will determine the possible sanctions that can be imposed on this offender. What follows is an investigation by the police to find out the reasons, possible witnesses and motivation. So it is not the case that without witnesses it would not be possible to prosecute a person of such violence.”
