In the second reading, the Saeima today supported the amendments proposed by President Edgars Rinkēvičs to the Education Law, which provide for allowing school principals to search students’ belongings and restrict their movement for security reasons.

In the event of a threat to the safety, health or life of the head of the educational institution or his authorized person, it is planned to give the right to demand the presentation and inspection of the student’s personal belongings, as well as to restrict the student’s movement. The Cabinet of Ministers will determine the order in which school principals do this.

Due to security reasons, the educational institution would have the right to restrict the basic human rights of the students to the inviolability of private life and freedom of movement stipulated in the Constitution, as far as it is necessary to prevent the threat.

It is intended that, when implementing the educational program, as well as in the related teaching and upbringing activities, the educational institution will determine the procedure in which teachers and students use technical means, including information and communication technologies, equipment, robotics parts and software.

The law includes a regulation that requires parents to inform the head of the educational institution about the child’s health and any other conditions that may affect the learning of the educational program and the persons involved in it. However, in practice there are cases when parents have not provided the mentioned information to the educational institution, and such non-provision of information has significantly affected the learning of the educational program and the persons involved in it.

The President of the State concludes that the obligation of parents, included in the law, to provide essential information about the child to the educational institution without the responsibility stipulated by the law, is often not fulfilled, therefore, following Rinkēvičs’ suggestion, he plans to impose a penalty of 100 to 200 euros on parents for deliberately not providing information.

The President of the State has previously emphasized that school safety in an educational institution should be a priority, without which a high-quality educational process is unthinkable – teachers, students, and the rest of the educational institution’s staff have the right to feel safe. Rinkēvičs believes that the legislator, balancing the right of educational institutions to act and the right of learners to rely on reasonable protection of their rights and interests, should find a reasonable balance that would not allow arbitrariness on either side.

Rinkēvičs noted that the purpose of the amendments is to address issues that the president has talked about a lot with educators during regional visits, with the trade union of Latvian education and science employees, as well as during meetings with teachers who have suffered violence, while the purpose of the amendments is to promote safety in schools. promote greater responsibility not only of the school, but also of the parents.
