Two adults will have the opportunity to legally strengthen their relationship by contacting a notary and entering into a partnership. This is foreseen by changes in several laws, which were adopted by the Saeima on Thursday, November 9, in the second – final – reading. The changes in the law will allow to ensure the legal and social protection of these persons. The law also establishes that partnership cannot be compared to marriage.

“Our Constitution guarantees rights and protection to every person and does not allow discrimination against people. Three years ago, the Constitutional Court stated that there is a group of people who are discriminated against – there are people who live in a partnership, but whose rights are not respected. If the partnership actually exists, we must not ignore it. It is essential that all people in our country are protected and that the state can help these people if such a need arises,” says Andrejs Yudins, chairman of the Legal Commission responsible for the progress of the bill in the Saeima, justifying the need for a partnership institute.

When cohabiting or establishing a joint farm, close personal relationships based on mutual responsibility, care for each other, loyalty, understanding and respect can be formed between two adults, the authors of the bill express, stressing that the basic law of our country – the Constitution – requires ensuring this legal, economic and social protection of relations.

Changes in the laws provide that the partnership can be concluded from July 1 of the next year.

With the amendments to the Notary Law, it is stipulated that a sworn notary will draw up a notarial deed on a partnership if two natural persons of legal age come to him together in person and certify that they have a close personal relationship, a joint farm and the intention to take care of it, as well as provide for and support each other . People who are married, relatives in the direct line, as well as brothers and sisters, half-brothers and half-sisters will not be able to form a partnership, according to the amendments to the law.

The partnership will end with the death of a person or if the court declares one of the persons to be dead, with the marriage of one or both persons, with the statement of will of both persons to a notary or with a court judgment. A sworn notary will include information about the partnership in the Register of Natural Persons, thus the state and municipal authorities will be able to identify persons who have registered and terminated the partnership.

With the amendments to the Law of Patients’ Rights, it is established that people in a partnership will have the right to make a decision on consenting to the other’s treatment, the method used in the treatment, or refusing it.

Amendments to the Law “On State Pensions” provide that the partner will have the right to obtain social guarantees, including, in the event of the death of the other partner, to receive the calculated pension amount that has not been paid until the person’s death. Also, the Law “On Personal Income Tax” provides tax relief from various property disposal transactions, including gifts, as well as loans, if the transactions will take place between people in a partnership.

With the amendments to the law “On the prevention of conflict of interest in the activities of public officials”, it is established that the official’s partner will be subject to the same restrictions that are currently imposed on the official’s relatives. The partnership will need to be listed in the public official’s declaration.
